Road at <br />"West 0": The cross-hatched area represents the area where the south <br />shoulder of the road and the drainage swale has encroached approximately <br />12-15 ft. onto•the land designated as. tract "C" and tract "D". <br />The roadway was staked and constructed by Brown & Root, Inc. when <br />they located a portable asphaltic concrete batch plant on their 18.9+ <br />acre site located at the west end of "West 0"~. After discussing the <br />matter with all parties involved, staff recommends the following course <br />of action: <br />(1) Negotiate with the landowner for: <br />(a) the abandonment of the existing 60' ROW of "West 0" <br />(b) have a new field note description written for a <br />60' ROW that would be approximately .l2-15 ft. south <br />of and parallel to the existing ROW. <br />NOTE: Brown & Root, Inc. has indicated .that <br />they would cover the costs associated <br />with a new field note description and <br />placement of appropriate monumentation. <br />(c) abandon 17th street in its present location and pre- <br />pare a new field note description for a 60'. wide ROW <br />along the western boundary of tract .from the north <br />.line of tract A to the north ROW line of the newly <br />described "West 0" ROW. <br />NOTE: .This action would be in line with the <br />staff recommendation made earlier when . <br />the 'owner requested the closing of. South <br />.. 17th Street. <br />(2) Request Brown & Root, Inc. to relocate the metal gate to a <br />point just inside their ROW. <br />Ui <br />
