<br />....---- <br /> <br />\ <br /> <br />.' <br /> <br />September 5, 1984 <br /> <br />I am addressing you on behalf of residents of Beck's addition to <br />Oakhurst addition concerning surveys. <br /> <br />The addition to Oakhurst was dedicated in 1926 in a very simple <br />manner. All lots are laid out with straight boundary lines, 900 <br />corners, and the same width on each end except the lots following <br />the bay shoreline. It's very easy to measure - nothing difficult <br />to spot large encroachments. All measurements I have taken to <br />fences and other reference points are within inches except for <br />two fepces involving one property owner - one of the two fences <br />is eight-to-ten feet in public property on a right-of-way leading <br />to the bay. This right-of-way was dedicated to all the people of <br />the Oakhurst Addition, not just for the use of one property owner. <br /> <br />As you know, a survey was made in 1965 by a professional engineer <br />and registered in Texas for survey work. Survey stakes he placed <br />on Lot 18, Block. 5, and other long-standing references point out <br />these encroachments. It's simple, easy to see and important. You <br />do not need a $3,500 survey. The evidence of encroachments' I <br />mention are visible. Ask the encroacher to produce a registered <br />survey and show his property locating points. Don't tell all the <br />other residents of Oakhurst their surveys are wrong. <br /> <br />You are aware of the fences in question, they have been in their <br />present location a short time. There have been other fences on <br />Lots 1 and 2, Block 3, through the years; but none of the previous <br />owners elected to fence public property. I know first hand about <br />the location of all these fences., I was reared on the property <br />just west of Lots 2 and 3, Block 3; and my parents still reside <br />there. All long term residents in this area know where the old <br />fences were located. <br /> <br />I request you to act in a manner benefiting all citizens of Oakhurst <br />and LaPorte. Listen to your legal representative when he states the <br />law is strongly in favor of the City. You have all the evidence you <br />need. Please ask this property owner to remove his obstructions from <br />public property.. This is all you have to do. <br /> <br />If we did not have people with this PacMan approach of gobbling up <br />property trying to alter well-defined property lines, our need for <br />surveys and attorneys would be less. You must act on these encroach- <br />ments I speak of. Think of the message you are sending this man, as <br />well as others in our community, if you do not act on these encroach- <br />ments. The encroachments I mention can be easily corrected. They <br />were called to your attention in a timely manner. They were called <br />to this property owner's attention prior to installation; no permit <br />was issued; and all of you know the facts I have presented are true. <br />This property owner is encroaching on public property. <br /> <br />A I I <br />
