• • <br />• <br />THE STATE OF TEXAS § <br />COUNTY OF HARRIS § <br />This Agreement made and entered into by and between the CITY OF <br />LA PORTE, a municipal corporation of Harris County, Texas, hereinafter <br />called "CITY" and BAYSHORE MUNICIPAL UTILITY DISTRICT, a conservation <br />and reclamation district of the State of Texas, hereinafter called <br />"BMUD". <br />RECITALS <br />I. <br />• This Agreement is made and entered into under the authority of <br />The Texas Interlocal Cooperation Act, Article 4413(32c) V.A.T.S. <br />II. <br />BMUD is in need of a source of potable water to furnish to <br />resi8ential and commercial customers in the proposed Bayou Forest <br />Subdivision, a proposed subdivision of 110.7 acres in the W. P. Harris <br />Survey, Abstract No. 30, Harris County, Texas. CITY is agreeable to <br />furnish potable water to BMUD, at a point of delivery on the north <br />boundary line of said Bayou Forest Subdivision, at or near McCabe <br />Road, near the south city limit line of CITY, under the terms and <br />conditions of this Agreement. The source of potable water to be <br />furnished by CITY to BMUD is well water, and this agreement shall <br />be in all things subject to the granting and renewal of appropriate <br />• permits by the Harris-Galveston Coastal Subsidence District, for <br />pumpage by CITY of water in the quantities which CITY agrees to <br />deliver to BMUD under the terms of this Agreement, and CITY'S obliga- <br />tions under this Agreement shall be in all things subject to the <br />granting and continuation of such permits, and is limited thereby. <br />• <br />TERM ' <br />The term of this Agreement shall be for a period beginning <br />October 1, 1984, and continuing until potable water is made available <br />to BMUD by the La Porte Area Water Authority, at which time CITY, at <br /> <br />
