• <br />j• • • <br />CITY OF LA PORTE <br />'• INTER-OFFICE MEMORANDUM <br />T0: JA WF,N, CITY MANAGER <br />FROM: JO .ERNS, DIRECTOR OF COMMUNITY DEVELOPMENT <br />DATE: DECE B .R 19, 1984 <br />SUBJECT: UTILITY EXTENSION AGREEMENT FOR INSTALLATION OF 12" <br />AND 8" 41ATERLINES TO FAIRMONT PLAZA SHOPPING CENTER - <br />C.L:~.~NO. 84-6105 <br />In July of 1984 the City entered into a standard utility <br />extension agreement with Fairmont Plaza Joint Venture for the <br />extension of 8" and 12" waterlines and installation of three <br />fire hydrant assemblies. The agreement included a provision for <br />the City to participate in the cost of the 12" waterline <br />installation subject to council approval and competitive <br />bidding. <br />CJ <br />The standard utility extension agreement also calls for the <br />developer's engineer to prepare plans and specifications for <br />review and approval by the City. Unfortunately, the architect <br />on the project issued a change order and the contractor .began <br />installation of the 12" waterline based on a revised plumbing <br />and site plan drawing from the architect. Since plans and <br />specifications had not been approved, the City stopped <br />construction of the wateline. <br />Since that time, I have met with representatives of Fairmont <br />Plaza Joint Venture, their general contractor, and their <br />engineer to discuss: <br />(1) the approved plans and specifications vs. what was <br />installed by the contractor prior to being "shut <br />down". <br />(2) the steps necessary to complete construction according <br />to the approved construction drawings and <br />specifications. <br />(3) the City's position on participation in the oversizing <br />since the project was not competitively bid. <br />• <br />
