Fairmont Park West <br />ommunity Improvement Association, In . <br />P. 0. Box 521 <br />LA PORTE, TEXAS 77571 <br />BE IT KNOWN TO ALL MEN BY THESE PRESENTS: <br />WHEREAS Houston Chemical Services Incorporated, a Texas <br />Corporation, hereinafter referred to as HCS has applied with <br />the State of Texas Eor a permit to construct and operate a <br />hazardous waste incinerator on Bay Park Road in the extra- <br />territorial jurisdiction of the City of La Porte, Texas; and <br />WHEREAS said incinerator will be located eight-tenths mile <br />south of the nearest residence and one and one-tenth miles <br />southeast of the nearest public school, which prevailing <br />winds would carry emissions in the direction of these <br />approximately Fifty percent of the time an~iua2~IJi acid <br />WHEREAS HCS will operate a combination rotary-kiln and <br />fluid-bed incinerator if the permit is approved, the <br />efficiency of which is as yet unproven; and <br />WHEREAS HCS is a newly formed entity with no proven track <br />record of responsibility toward meeting and maintaining the <br />critical emissions control that would be necessary; and <br />WHEREAS the additional traffic in the way of trucks hauling <br />hazardous chemicals to the site via roadways not suited Eor <br />such would be potentially disastrous, i.e.; an accident or a <br />spill, a disaster HCS would be under no legal obligation to <br />help contain or clean up; and <br />WHEREAS there exists no plan for the orderly evacuation or <br />notification of area residents in their homes or students at <br />the public schools should there be an escape of toxic gases <br />or emissions From the proposed site; and <br />WHEREAS the majority of residents of this neighborhood has <br />demonstrated disfavor toward the granting of this permit and <br />the installation and operation of this incinerator at the <br />proposed site. <br />BE IT THEREFORE RESOLVED that the Board of Directors of <br />Fairmont Park West Community Improvement Association is <br />hereby opposed to the location of the incinerator site <br />proposed by HCS and hereby requests that their application <br />be denied. <br />BE IT FURTHER RESOLVED that this board will support the <br />granting of a~permit to HCS Eor an incinerator site which is <br />not bounded by residences or educational facilities within <br />such close proximity, nor will cause a hazard Eor traffic. <br />BE IT STILL FURTHER RESOLVED that this resolution be read in <br />its entirety into the minutes of the next board meeting and <br />a copy be presented to the city council of the City of <br />La Porte, the Texas Water Commission and the Texas Air <br />duality Board. <br />Carl Foerguson <br />~cz+~ f <br />President, Fairmont Park West <br />Community Improvement Assoc. <br />A test: <br />Sandi Ogg <br />Secretary, FPW- I <br />
