<br />e <br /> <br />e <br /> <br />~- <br /> <br />THIS CONTRACT IS SUBJECT TO ARBITRATION <br />UNDER THE TEXAS GENERAL ARBITRATION ACT <br /> <br />CONTRACT FOR THE SUPPLY OF POTABLE WATER AND THE <br />CONSTRUCTION, FINANCING AND OPERATION OF WATER TREATMENT <br />TRANSMISSION AND DISTRIBUTION FACILITIES <br /> <br />THIS CONTRACT (the "ContractU) made and entered into as of <br /> <br />the <br /> <br />day of <br /> <br />, 19_, by and between La Porte Area Water <br /> <br />Authori ty (the "Authori ty.), a conservation and reclamation district <br /> <br />in Harris County, Texas, and a governmental agency and a body politic <br /> <br />,.and corporate, created by Chapter 729, page 2678, Acts of the 67th <br /> <br />Legislature of the State of Texas, Regular Session, 1981 (the "Act"), <br /> <br />and the City of La Porte, Texas, a municipal corporation of the State <br /> <br />of Texas (the "City"), <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, the Harris-Galveston Coastal Subsidence District <br /> <br />(the uSubsidence District"), was created by the Legislature of Texas <br /> <br />in 1975 for the purpose of regulating the wi thdrawal of groundwater <br /> <br />from the area wi thin the boundaries of Harris County and Galveston <br /> <br />County in order to end subsidence which contributes to or precipitates <br /> <br />flooding, inundation or overflow of any area within the District; <br /> <br />WHEREAS, the Subsidence District is charged wi th the duty <br /> <br />and has the power to control and prevent subsidence within its <br /> <br />boundaries by reducing the amount of groundwater withdrawals from <br /> <br />all wells wi thin the Subsidence District which produce groundwater, <br /> <br />including those owned and operated by corporations, governmental <br /> <br />subdivisions or agencies and other organizations; <br /> <br />WHEREAS, the Ci ty and other Participants named in Section <br /> <br />2.01 hereof are required by the rules and regulations of the Subsidence <br />
