• <br />• <br />Fraternal Order of <br />Special Conditional <br />Page 2 <br />the Eagles <br />Use Permit <br />Steve Gillett, Director of Public Works, has approved of the same <br />type of surfacing for the alley. The City will not maintain the alley <br />and if the City needs to repair the utilities in the alley, the repair <br />of the surface will be at the Eagles expense. <br />The conditions listed above reflect requirement of City Ordinance. <br />A final suggested condition is a prohibition of parking lot egress on <br />the 7th Street face of the property. This recommendation is not based <br />on ordinance requirements but rather on the number of residences <br />located in this block of 7th Street. The Eagles are -not proposing a <br />7th Street entrance at this time. <br />Conclusion• <br />Subject to the required approvals of screening and surfacing plans, <br />this request meets all prerequisite conditions necessary for the <br />issuance of a special conditional use permit. In summary, these <br />conditions are again as follows: <br />1. Parking surface, including existing on site parking, must <br />be surfaced to control dust as per Section 10-605(7). <br />Surfacing must be approved by the Director of Community <br />Development. <br />2. Parking surface must be setback 25 feet from the front property <br />and 10 feet from the exterior side property line as per <br />Section 10-607(5). <br />3. The 7th Street and "G" Street face of the lot must be screened from <br />public view as per Section 10-6050 1). The screening plan must be <br />approved by the Director of Comm. Development. <br />4. Any surfacing of the alley of Block 149 must be approved in advance <br />by the Director of Public Works. <br />5. The final suggested condition is that no parking lot entrances be <br />allowed onto 7th Street. <br />6. The alley will not be used for primary access to the parking lot. <br />7. A Release to be prepared by the Fraternal Order of the Eagles <br />stating that the City of La Porte will not be held responsible <br />for any repairs to the paved surface of the alley should the City <br />need to repair any utilities located therein. The Fraternal Order <br />of the Eagles will also hold the City harmless of any injuries <br />occuring on said alley. This letter must be acceptable to the City <br />of La Porte Attorney's Office. <br />
