<br />Page 2 of 2 <br /> <br />e <br /> <br />e <br /> <br />In consideration for the license McDonald's shall: <br /> <br />- Execute an easement agreement between McDonald's <br />Corporation & HL&Pj <br /> <br />- Landscape & maintain the west 4' of such alley per terms <br />of La Porte Zoning Ordinance #1501j <br /> <br />- Landscape and maintain the approximate east 15 feet of <br />the Harris County Flood Control District right-of-way in <br />accordance with the requirements of the HCFCD (to be <br />passed on through the City of La Porte); <br /> <br />- The continued maintenance of this landscaping shall be a <br />consideration for the continuance of this license <br />agreement; <br /> <br />- Either abandon the existing waterline per City's <br />specifications or maintain the waterline during the term <br />of this licensej <br /> <br />- Remit to City of La Porte all net rentals received under <br />lease agreement between McDonald's Corporation and La <br />Porte State Bank. <br /> <br />In consideration for the license the predecessor in title to <br />McDonald's Corporation shall: <br /> <br />- Be required to deposit the sum of $5,811 cash with the <br />City of La Porte as a performance guarantee which will <br />be refunded upon the completion of the required <br />landscaping and the issuance of a Certificate of <br />Occupancy. <br /> <br />The proposed ordinance, if passed, becomes effective only upon; <br /> <br />1) The purchase of lots Twenty (20) through Thirty-Two <br />(32), Block Eleven Hundred One (1101), Town of La Porte, <br />Harris County, Texas, by McDonald's Corporation; <br />2) The execution and delivery of an easement by McDonald's <br />Corporation to Houston Lighting & Power Company; <br />3) The execution by McDonald's Corporation of an agreement <br />for landscaping of the "Conservation setback" areas; <br />4) The execution of a mutually agreeable sign lease between <br />McDonald's Corporation and La Porte State Bank; and <br />5) The delivery of the $5,000.00 cash performance guarantee <br />as provided for in Section 3 hereof. <br /> <br />Action Required by Council: <br /> <br />Approval of Ordinance #1603 granting a license to McDonald's <br />Corporation for use of'a portion of the alley in Block 1101; <br />providing a cash performance guarantee and providing other terms <br />and conditions of said license. <br /> <br />Availability of Funds: <br /> <br />General Fund <br />Capital Improvement <br />Other <br /> <br />Water/Wastewater <br />General Revenue Sharing <br /> <br />Account Number: <br /> <br />Funds Av~ilable: <br /> <br />YES <br /> <br />NO <br /> <br /> <br /># <br />DATE I <br />
