Herrera Department: Administration <br />Report XX Resolution <br />Ordinance <br />Exhibits: Memo from City Secretary <br />Correspondence from Mayor Emmett Hutto, Baytown <br />HJR 17 <br />HB g8 <br />News Release from Bob Richardson, Dist. 4g <br />Correspondence from Jeff Archer, Texas Legislative <br />Council <br />City of La Porte Resolution 8g-~4 <br />SUMMARY & RECOMMENDATION <br />House Bill g8 addresses a proposed amendment to the Texas <br />Constitution which would prohibit municipalities from imposing a <br />municipal income tax. There is no provision in the Constitution <br />prohibiting imposition of such a tax, and if a city's charter <br />provides that it has the power "to levy, assess and collect taxes <br />for any municipal purposes...on persons, privileges, subjects, and <br />occupations", this could be construed as having power to impose a <br />municipal income tax on its citizens. <br />If House Bill g8 is approved, an amendment to the Constitution <br />prohibiting municipalities from imposing income taxes would be put <br />on the ballot for the November 7j 198g, election. However, it <br />would not prohibit taxing of a franchise or° occupation tax, or a <br />license fee on the gross receipts of a business or occupation. <br />It is recommended that Resolution 89-4 be approved and the City <br />Secretary instructed to send certified copies to our legislators <br />and the Governor of Texas. <br />Action Required by Council: Approval of Resolution 8g-4. <br />Availability of Funds: N/A <br />General Fund Water/Wastewater <br />Capital Improvement General Revenue Sharing <br />Other (Motor Pool Replacement Fund) <br />Account Number: <br />Funds Available: _ YES _ NO <br />roved for Cit u c'1 <br />Robert T.
