Joerns <br /> <br />Department: Administration <br /> <br />XXX Report <br />Exhibits: <br /> <br />Resolution Ordinance <br /> <br />1) Status of 1985 General Obligation Bond Fund/Interest Earned <br /> <br />SUMMARY & RECOMMENDATION <br /> <br />On October 17, 1988, the contractor on the Little Cedar Bayou Park <br />wave pool, Crystal Pools Company, Inc. filed for bankruptcy. <br />Since then the City has been cooperating with the Surety, Texas <br />Insurance Company, to see that the contract is successfully <br />completed. The Surety retained another firm to complete the <br />project as defined by our contract and the project plans and <br />specifications. <br /> <br />On February 9th, 1989, the Surety's contractor was issued a <br />certificate of substantial completion. Subsequently, on March <br />8th, 1989 the City informed the Surety that repairs were necessary <br />to the pool deck (built by another contractor). The City believes <br />that the cracks in the pool deck is the responsibility of Crystal <br />Pools, Inc. due to non-conformance with the plans and specs. <br /> <br />Texas Insurance Company has taken the position that the cracking <br />in the deck is not their responsibility and plan no correcting <br />action. <br /> <br />Staff has prepared a scope of work describing the extent of the <br />repairs necessary and is in the process of obtaining a minimum of <br />two quotes. Delaying this repair work would complicate and <br />forestall the final settlement negotiations and also negatively <br />impact the proposed grand opening (Memorial Day Weekend) and our <br />estimated revenues. Therefore, Council is requested to declare <br />this item an emergency and authorize the award of repair work to a <br />qualified firm submitting the most responsive and responsible <br />quote. The time to complete the repairs will be evaluated along <br />with the price quoted. <br /> <br />NOTE: The quotes will be provided to Council at Monday, April <br />10th, 1989, meeting. <br /> <br />Funds for this item are available from the interest earned on the <br />1985 Bond Funds. The City will pursue the reimbursement of this <br />account during final settlement negotiations with the Surety. <br /> <br />Action Required by Council: <br /> <br />Declare this item an emergency and authorize repairs to the pool <br />deck at Little Cedar Bayou Park.
