II. • <br />MATERIALS TO BE DISPOSED OF <br />Hughes shall accept, upon compliance of the City with the terms and <br />conditions in this instrument, all of the City"s brush and <br />construction-demolition wastes, but not including tires, hazardous wastes, <br />household garbage, nor barrels. <br />III. <br />OPERATION OF SITE <br />(A) Hughes will have the exclusive right and responsibility to <br />operate the landfill site in compliance with the provisions of <br />this Agreement. <br />(B) Hughes will operate the landfill site in compliance with the <br />rules and regulations of the Texas State Department of Health <br />regarding minimum standards of operation for Class IV sanitary <br />landfills, and the requirement of other State and Federal <br />agencies pertaining to the disposal of solid wastes, and shall <br />comply with all the laws of the State of Texas and the ordinances <br />of the City of Pasadena and will maintain current all necessary <br />and required licenses and permits for the operation of a Type IV <br />sanitary landfill. <br />(C) Hughes shall furnish all labor, tools, and equipment necessary to <br />operate the site and shall be responsible for all required <br />maintenance thereof. Supervision by an experienced person shall <br />be provided at all times when the sanitary landfill is open for <br />use or operation. <br />IV . <br />COMPENSATION <br />As full compensation to Hughes for operation of the above referred to <br />landfill by Hughes, the City agrees to pay to Hughes Two Dollars ($2.00) <br />per cubic yard. Payment shall be based on the number of cubic yards of <br />municipal trash/rubbish delivered to Hughes under the terms of this <br />Agreement, it being Further specifically understood and agreed by and <br />between the parties, with respect to the aforesaid compensation that the <br />compensation to be paid will be based upon predetermined refuse truck <br />capacities which ,are agreed upon between Hughes and City. <br />
