e e REQUEST FOR CITY COUNCIL AGENDA ITEM ----------------------------------------------------------------- ----------------------------------------------------------------- Agenda Date Requested: April 9, 1990 Requested by: Joel Albrecht Dept: Community Development x Report Resolution x Ordinance Exhibits: 1) 2 ) 3) Special Conditional Use Permit nSCU90-002 Planning & Zoning Commission Transmittal letter Staff Report and Exhibits ----------------------------------------------------------------- ----------------------------------------------------------------- SUMMARY & RECOMMENDATION Summary: The La Porte Planning and Zoning Commission on February 15, 1990, met in Public Hearing and regular session to consider a request by Fairmont Park Baptist Church for a Special Conditional Use Permit. The purpose of this request is to allow permanent placement of a portable storage building on the church's property located at 10401 Belfast Drive in Fairmont Park. The building is to be used for church storage. Under the requirements of Ordinance 1501, Section 5-600, Table A, a Special Conditional Use Permit is required before this or any other expansion of a religious facility may take place in an R-1, residential zone. Recommendation: The Planning and Zoning Commission, by unanimous vote, has recommended denial of this request. Options: I. Approve Special Conditional Use Permit nSCU90-001: A. As requested by applicants B. With added conditions II. Table SCU90-00l for further consideration at a future date. III. Deny SCU90-001 as recommended by Planning and Zoning Commission. NOTE: Zoning Ordinance Section 11-507.8 states: "The affirmative vote of at least three fourths (3/4) of the City Council is required to overrule a recommendation of the City Planning and Zoning Commission that a proposed change to this Ordinance or boundary be denied." Zoning Ordinance Section 10-201.5 states: "Every Special Conditional Use Permit granted as provided herein shall be considered as an amendment to the Zoning Ordinance as applicable to such property. A three quarter (3/4) majority of Council must vote to approve SCU90-001 in order for it to be granted.
