Albrecht Department: Community Develo'Pment <br /> <br />Report <br /> <br />Resolution <br /> <br />x <br /> <br />Ordinance <br /> <br />Exhibits: <br /> <br />Ordinance No. 1705 <br /> <br />----------------------------------------------------------------- <br />----------------------------------------------------------------- <br /> <br />SUMMARY & RECOMMENDATION <br /> <br />The 70th Legislature enacted the Nation's first comprehensive <br />impact fee enabling statue in 1987, which is known as S.B. 336. <br />Senate Bill 336 authorized municipalities to impose impact fees <br />against new development. These fees include dedication for rights- <br />of-way, requirements to construct capitol improvements, fees in <br />lieu of dedication or construction, impact fees for public <br />services, and fees or charges which are assessed against <br />development projects to mitigate environmental or social impacts. <br /> <br />The Bill prohibits the collected fees to be used to construct, <br />acquire or expand any public facilities other than capital <br />improvements identified in the capital improvement plan.
