Smith, Chief of Police <br />SUBJECT : Administrative Report <br />Ordinances Pertaining to Vicious Animals <br />At last session, Council asked that staff look into legislation dealing with <br />animals of vicious tendencies. <br />We have been in contact with the TML Legal Division who forwarded to us some <br />sample ordinances. Copies of these samples are provided for Councils' review. <br />TML's Legal Division indicated the sample they considered best written is from <br />the City of San Antonio. <br />Recently, the City of Richardson, Texas was involved in a court battle concerning <br />legislation they enacted dealing with vicious animals. The Texas Supreme Court <br />has upheld that legislation. <br />It does appear that these ordinances must be generic enough to cover all animals. <br />If they are written to address the issues of safety and public health and do not <br />appear to discriminate against a particular breed of animal, then enacted <br />legislation is legal. <br />If it is Councils' wish, we will pursue development of a vicious animal amendment <br />to our Ordinance No. 1559 and bring it to Council for review. <br />
