<br />ORDINANCE N0. 1093-C PAGE 6 <br />g 92.261. Landlord's Defenses <br />The landlord has a defense to liability under Section 92.259 if: <br />(1) on the date the tenant gives the notice required by Section <br />92.259 the tenant has not paid all rent due from the tenant; or <br />(2) on the date the tenant terminates the lease or files suit <br />the tenant has not fully paid costs requested by the landlord and <br />authorized by Section 92.258. <br />§ 92.262 Agents for Deliver of Notice <br />A managing or leasing agent, whether residing or maintaining an <br />office on-site or off-site, is the agent of the landlord for <br />purposes of notice and other communications required or permitted by <br />this subchapter. <br />Section 2. Unless and only to the ex!~ent expressly preempted <br />by the provisions of Chapter 92,, Texas Property.Code, as adopter by <br />this Ordinance, the provisions of all building and housing codes of <br />the City of La Porte shall remain in full force and effect. <br />Section 3. If any section, paragraph; subdivision, clause, <br />phrase, or provision of this Ordinance shall be judged invalid or <br />unconstitutional, the same shall .not affect the validity of this <br />Ordinance as a whole or any part or portion thereof, other than the <br />portion so decided to be invalid or unconstitutional. <br />separate offense. <br />Section 4.
