<br />-- <br /> <br /> <br />e <br /> <br />, <br />(g) Any such TRANSMISSION MEDIA shall be so located on the <br />FACILITIES as to be safe and not to interfere unnecessarily with the <br /> <br />use of the RIGHTS-OF-WAY by others, including persons or entities <br /> <br />authorized to use the FACILITIES. The TELEPHONE COMPANY shall not <br /> <br />be required to attach its TRANSMISSION MEDIA to the facilities of <br /> <br />any other person or entity or to permit the transmission media of <br /> <br />any other person or entity to be attached to TELEPHONE COMPANY'S <br />FACILITIES if it can be shown satisfactorily to the CITY that the <br /> <br />TELEPHONE COMPANY will be subjected to increased risks of <br /> <br />interruption of service or to increased liability for accidents, or <br /> <br />if the facilities of such other person or entity are not of the <br /> <br /> <br />character, design, and construction required by, or are not being <br /> <br />maintained in accordance with industry standards or practice. <br /> <br />Provided, however, nothing herein shall modify or abrogate the power <br /> <br />of the CITY to require the use of FACILITIES as herein above <br /> <br />provided. <br /> <br />(h) Upon not less than 48 hours advance notice, the TELEPHONE <br /> <br />COMPANY shall promptly move or remove its aerial FACILITIES <br /> <br /> <br />temporarily to permit the moving of houses or other bulky structures <br /> <br />when necessary. <br /> <br />The expenses of such temporary relocation or <br /> <br />removal shall be paid by the party or parties requesting and <br /> <br />benefiting from such temporary relocation or removal, and the <br /> <br />-11- <br />
