The recommendation of the Planning <br />and zoning commission is attached as an exhibi t of the <br />ordinance. <br /> <br />----------------------------------------------------------------- <br />----------------------------------------------------------------- <br /> <br />SUMMARY & RECOMMENDATION <br /> <br />Summary: <br /> <br />The Planning and Zoning Commission, at its June 18, 1992, Public <br />Hearing and regular meeting considered rezoning request R92-001. <br />This request seeks to have a thirteen plus acre tract of property <br />rezoned from R-2, Mid-Density Residential to BI Business <br />Industrial. The property in question, which is developed and <br />operated as a warehouse/truck terminal, is located north of <br />Fairmont Parkway, adjacent to a private road commonly referred to <br />as Canada Road. The Planning and Zoning commission has recommended <br />denial of this request. <br /> <br />Recommendations: <br /> <br />Staff concurs with the Planning and Zoning commission and <br />recommends denial of Rezoning Request R92-001. <br /> <br />----------------------------------------------------------------- <br />----------------------------------------------------------------- <br /> <br />Action Required by Council: <br /> <br />1. Conduct Public Hearing to take public comments regarding <br />Rezoning Request R92-001. <br /> <br />* <br /> <br />2. Consider adoption of Rezoning Ordinance 1501-P , or; <br /> <br />3. Deny rezoning by voting not to adopt Ordinance 1501-P. <br /> <br />. Should Council choose to approve the rezoning, the provisions <br />of Zoning Ordinance, Section 11-507. 8 will apply. This <br />section states: <br /> <br />The affirmative vote of at least three-fourths <br />(3/4) of the City council is required to overrule a <br />recommendation ... that a proposed change to this <br />ordinance or boundary be denied. <br /> <br />Should less than a three-fourths (3/4) majority of the <br />Council vote to adopt Ordinance 1501-P, the rezoning will <br />still be denied. <br /> <br />----------------------------------------------------------------- <br />----------------------------------------------------------------- <br />
