• Y <br />. ~(: <br />M~ <br />REQUEST FOR CITY COUNCIL AGENDA ITEM <br />AGENDA DATE REQUESTED Aril 26, 1993 <br />REQUESTED BY Jeff Litchfield DEPARTMENT Director of Finance <br />REPORT RESOLUTION XX ORDINANCE <br />EXHIBITS: Ordinance <br />SUMMARY AND RECOMMENDATION <br />At the April 12, 1993 work shop with City Council regarding changes to the <br />Utility Billing Operation, the topic of an ordinance that allows the City to <br />file a lien against the property for delinquent City utility bills was <br />discussed. <br />State law allows the City to file a lien against a property when the user <br />fails to pay the City for City provided utilities. The lien process is <br />similar to that which we use for our demolition and lot mowing liens. <br />There are two cases where we can not file a lien against the property. They <br />are: <br />^ When the property is a homestead as protected by the Texas <br />Constitution, or <br />^ The property is rental property and the owner of the property has <br />provided notice to the City that the property is rental property. <br />We believe that the passage of this ordinance will provide the City an <br />opportunity to collect some amounts due for previous utility service that <br />would otherwise be uncollectible. <br />ACTION REQUIRED BY COUNCIL: <br />Approve or disprove the Ordinance allowing the City to place liens on an <br />owner's property for delinquent municipal utility bills. <br />AVAILABILITY OF FUNDS: <br />GENERAL FUND UTILITY FUND OTHER <br />ACCOUNT NUMBER: N/A FUNDS AVAILABLE: YES NO <br />APPROVED FOR CITY COUNCIL AGENDA <br />ROBERT T HERRERA DATE <br />CITY MANAGER <br />
