The law requires employers with 50 or more employees to offer its workers up to twelve (12) weeks of unpaid leave for family medical emergencies or the birth or adoption of a child. This law went into effect August 5, 1993. This item was taken before City Council on September 27, 1993, as a workshop item. The attached ordinance amends the City's Personnel Policy Manual and incorporates .the changes recommended by Council during that workshop, including: Allowing all full time, regular employees to take up to 12 weeks of unpaid leave because of the birth or adoption of a child (whether that employee is the mother or father), or if his or her spouse, child or parent suffers a serious illness. If requested by the employee, any accrued vacation leave balance may be substituted for unpaid leave, first, and the remainder of the 12 weeks shall be with no pay. In addition, an employee is entitled to a leave if his or her own medical condition prevents the employee from working. If requested by the employee, any accrued sick leave balance may be substituted for unpaid leave, first, then any accrued vacation leave balance may be substituted, and the remainder of the 12 weeks shall be with no pay. In section 7, regarding notice of unforeseen events, the language from the statute was used: "...must give notice as soon as practicable, ordinarily within one or two working days."
