Second by councilperson Cooper. The motion <br />carried, 9 ayes and 0 nays. <br /> <br />Nays: <br /> <br />councilpersons sutherland, Cooper, <br />McLaughlin, Porter, Gay, Maxwell, Clarke <br />Malone <br />None <br /> <br />Thrower, <br />and Mayor <br /> <br />Ayes: <br /> <br />(Councilperson Sutherland requested a copy of the "noise <br />ordinance" be placed in his mail box at City Hall.) <br /> <br />11. Council considered an ordinance approving and authorizing a <br />Landlord's Waiver and Subordination Agreement dated March 28, <br />1994, between the City of La Porte, Bayshore National Bank of <br />La Porte, and the La Porte Livestock Show and Rodeo <br />Association. <br /> <br />City Attorney Knox Askins pointed out the legal effect of this <br />agreement - "The City of La Porte is agreeing that the Bank <br />has a lien on the collateral. The worst possible case, if the <br />Bank does not get paid they will come get their collateral. <br />In no way does this make the City responsible for the payment <br />of the loan." <br /> <br />City Attorney read: ORDINANCE 94-1975 AN ORDINANCE <br />APPROVING AND AUTHORIZING A LANDLORD'S WAIVER AND <br />SUBORDINATION AGREEMENT DATED MARCH 28, 1994, BETWEEN THE CITY <br />OF LA PORTE, BAY SHORE NATIONAL BANK OF LA PORTE, AND THE LA <br />PORTE LIVESTOCK SHOW AND RODEO ASSOCIATION; MAKING VARIOUS <br />FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br /> <br />Motion was made bv Councilperson Clarke to pass Ordinance 94- <br />1975 as read bv the citv Attorney. Second by councilperson <br />Cooper. The motion carried, 9 ayes and 0 nays. <br />
