RESOLUTION NO. 94- 09 <br />A RESOLUTION REQUESTING PRIME CABLE, THE CITY'S FRANCHISED CABLE <br />TELEVISION OPERATOR, TO RECONSIDER ITS DECISION TO DELETE C-SPAN <br />AND CNBC FROM ITS PROGRAMMING TO ITS LA PORTE SUBSCRIBERS; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, <br />Section 1. Prime Cable offers cable television programming <br />to subscribers in the City of La Porte under franchise from the <br />City of La Porte. On September 9, 1994, Prime Cable dropped C- <br />SPAN, a cable television channel offering public affairs <br />programming and coverage of the United States House of <br />Representatives; and CNBC, a financial and public affairs <br />programming cable network; from its programming for its subscribers <br />in the City of La Porte, to make room for local stations whose <br />signals Prime Cable is required to carry by federal law. However, <br />the choice of channels to be deleted to accommodate the local <br />stations, was a policy decision made by Prime Cable, in its sole <br />discretion. <br />Section 2. Although the City of La Porte does not have legal <br />jurisdiction to control the programming offered by Prime Cable, the <br />City of La Porte nevertheless respectfully requests and urges Prime <br />Cable to reconsider its decision to drop C-SPAN and CNBC. The City <br />of La Porte has received communications from many of its citizens <br />who are subscribers to Prime Cable, complaining of the actions of <br />Prime Cable in dropping C-SPAN and CNBC from its cable lineup, <br />rather than other programming. <br />Section 3. In view of the overwhelming response from Prime <br />Cable subscribers, the City Council of the City of La Porte <br />
