Mayor Malone opened Public Hearing B at 6:45 P.M. <br /> <br />Public Hearing - B - Special Conditional Use Permit request <br />for the purpose of allowing a Commercial Planned unit <br />Development (P.U.D.). SCU 94-002, to be developed on an 11.79 <br />acre tract located in the 800 block of McCabe Road <br /> <br />Director of Planning Chuck Harrington read a letter from <br />Rescue Concepts, Inc., stating they are considering other <br />options for the location of their educational facility. They <br />stated, "We are aware of the concerns of the citizens of Shady <br />River; therefore, we feel at this time it would be in the best <br />interest of all concerned for R.C.I. to withdraw our request <br />for zoning. We appreciate the time and effort that you and <br />your staff have made in assisting us." Mr. Harrington stated <br />staff recommends the Council accept Rescue concepts, Inc. <br />withdrawal request for SCU 94-002 Special Conditional Use <br />Permit. <br /> <br />Mayor Malone asked for public input. There being none, the <br />public hearing was closed at 6:47 P.M. <br /> <br />11. Council considered Special Conditional Use Permit Request for <br />the purpose of allowing a Commercial Planned unit Development. <br /> <br />Motion was made by Councilperson Clarke that Council accept <br />the letter from Rescue Concepts. Inc. wi thdrawinq their <br />request for Special Conditional Use Permit SCU 94-002: that <br />this letter be entered into the city Council records and the <br />minutes of these proceedinqs: and any request they have for a <br />permi t be denied. Second by councilperson Cooper. The motion <br />carried, 8 ayes and 0 nays. <br /> <br />Ayes: <br /> <br />councilpersons Sutherland, Cooper, Thrower, <br />McLaughlin, Gay, Maxwell, Clarke and Mayor Malone <br />None <br /> <br />Nays: <br /> <br />12. Council considered an ordinance approving and authorizing the <br />City Manager to execute an agreement with Texas Department of <br />Transportation for right-of-way acquisition for reconstruction <br />of State Highway 146 from State Highway 225 interchange to <br />Fairmont Parkway. <br /> <br />Director of Planning Chuck Harrington reviewed and answered <br />questions regarding the request and stated staff recommends <br />Council approval and authorization. <br />
