Motion was made by Councilperson McLaughlin to approve Ordinance 95-2032-A as read by the Assistant City Attorney. Second by Councilperson Gay. The motion carried, 6 ayes, 2 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, Gay, and Mayor Pro Tem Porter Nays: Councilpersons Maxwell and Clarke 8. CONSIDER AN ORDINANCE APPROVING AND AUTHORIZING THE SALE AND CONVEYANCE BY THE CITY OF LA PORTE OF A PORTION OF LOT 5, BLOCK 3, SHADY RIVER SUBDIVISION, SECTION 2, HARRIS COUNTY, TEXAS TO ROBINSON CAPEN AND WIFE, MARIAN V. CAPEN (Ord. 95- 20431 - J. Joerns Assistant City Manager John Joerns recommended tabling this item. Mr. Joerns explained after the item was placed on the agenda, he received a call from a person in the community expressing an interest in the purchase or in the acquisition of this sale. Mr. Joerns stated, "After staff reviewed the request it was felt one of the State's law exemptions on public notice fit this particular situation. On further review of the State exemptions for public notice, I am recommending to Council we table this item tonight for further review with the City Attorney." Motion was made by Councilperson Maxwell to table item 8 until Council brings it back to the table. Second by Councilperson Cooper. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Maxwell, Clarke and Mayor Pro Tem Porter Nays: None 9. CONSENT AGENDA - ANY ITEM MAY BE REMOVED BY A COUNCILPERSON FOR DISCUSSION A. CONSIDER AWARDING A BID TO ALPHA -LEE ENTERPRISES, INC. FOR THE FOURTH OF JULY FIREWORKS DISPLAY - S. Barr Director of Parks and Recreation Stephen Barr reviewed the summary and recommendation for the request.
