The motion carried, 6 ayes, 2 <br />nays. <br />Ayes: Councilpersons Sutherland, Cooper, Thrower, Gay, <br />and Mayor Pro Tem Porter <br />Nays: Councilpersons Maxwell and Clarke <br />8. CONSIDER AN ORDINANCE APPROVING AND AUTHORIZING THE SALE AND <br />CONVEYANCE BY THE CITY OF LA PORTE OF A PORTION OF LOT 5, <br />BLOCK 3, SHADY RIVER SUBDIVISION, SECTION 2, HARRIS COUNTY, <br />TEXAS TO ROBINSON CAPEN AND WIFE, MARIAN V. CAPEN (Ord. 95- <br />20431 - J. Joerns <br />Assistant City Manager John Joerns recommended tabling this <br />item. Mr. Joerns explained after the item was placed on the <br />agenda, he received a call from a person in the community <br />expressing an interest in the purchase or in the acquisition <br />of this sale. Mr. Joerns stated, "After staff reviewed the <br />request it was felt one of the State's law exemptions on <br />public notice fit this particular situation. On further <br />review of the State exemptions for public notice, I am <br />recommending to Council we table this item tonight for further <br />review with the City Attorney." <br />Motion was made by Councilperson Maxwell to table item 8 until <br />Council brings it back to the table. Second by <br />Councilperson Cooper. The motion carried, 8 ayes and 0 nays. <br />Ayes: Councilpersons Sutherland, Cooper, Thrower, <br />McLaughlin, Gay, Maxwell, Clarke and Mayor Pro Tem <br />Porter <br />Nays: None <br />9.
