• RE VEST FOR CITY COUNC GENDA ITEM <br />Agenda Date Requested: November 27. 1995 <br />Requested By: Guy Rankin ~ Department: Planning <br />Report X Resolution Ordinance <br />Exhibits: <br />Resolution <br />Draft Ordinance (Exhibit A) <br />SUMMARY & RECOMMENDATION <br />J.A.C.Interests, Inc. (JAC) has filed an application with the City for vacating approximately <br />4 acres of vazious streets and alleys. JAC is the developer that has received approval of a <br />Preliminazy Plat for the Kroger -Fairmont Pazkway Center Subdivision from the Planning <br />and Zoning Commission. <br />This street and alley closing is fairly complicated. Besides the normal reviews, <br />determination of market value, and consent of adjacent property owners, it involves <br />retaining two temporazy easements (one for H.L.& P. and one for the City) while utilities <br />are being relocated. To date, all the matters necessary for consideration of an ordinance <br />vacating and closing the streets and alleys have not been resolved. JAC would like, <br />however, a sense of the Council on this matter so that they have a greater comfort level as <br />they spend more time and energy in completion of their negotiations. <br />Staff has prepazed a Resolution for Council's consideration. The Resolution, if passed, <br />would express Council's intent to pass an ordinance in substantially the form presented in <br />Exhibit "A",once all matters relating to the requirements of Chapter 21, Article III of the <br />Code of Ordinances for vacating and abandoning streets and alleys has been met. <br />Action Required by Council: <br />Consider approval of a Resolution expressing policy and sense of Council relating to the <br />application filed with the City by J.A.C.Interests, Inc. for vacating approximately 4 acres of <br />various streets and alleys in conjunction with the development of the Kroger -Fairmont <br />Pazkway Center Subdivision. <br />Availability of Funds: N/A <br />_ General Fund _ Water/Wastewater <br />_ Capital Improvement _ General Revenue Shazing <br />Other <br />Account Number: Funds Available: YES NO <br />Approved for City Council Agenda <br /> <br />
