<br />e <br /> <br />e <br /> <br />Staff Report <br /> <br />Zone Change Request #R96-003 <br /> <br />May 16, 1996 <br /> <br />Requested for: <br /> <br />Lots 17-32; Block 64; Town of La Porte, which is further described as <br />being located at 201 N. 3rd Street, La Porte, Texas. <br /> <br />Requested by: <br /> <br />David and Bryan Moore <br /> <br />Requested Zone Change: From Low Density Residential (R-1) to General Commercial (GC) <br /> <br />Background: <br /> <br />The property in question currently has four (4) warehouses with concrete <br />drives/parking within a fenced area. The present structures are located on <br />Lots 17-23 and the southern five foot (5') of Lot 24, and are considered a <br />pre-existing, non-conforming use in an R-1 zone. The undeveloped portions <br />of this property are the northern twenty feet (20') of Lots 24 and 25-32, and <br />are owned by the same individuals. <br /> <br />In acting upon a zone change request, the Planning and Zoning Commission <br />and in turn, City Council, are charged to consider the following factors: <br /> <br />· Was the current zoning designation reasonable? <br /> <br />· Was any error made in the assignment of the current zoning? <br /> <br />· Is the requested designation compatible with the intent and <br />goals of the City's Comprehensive Plan? <br /> <br />It is the burden of the applicant to demonstrate whether any of these criteria <br />have been satisfied. <br /> <br />Purpose: <br /> <br />The applicant seeks to expand a pre-existing, non-conforming use by building five <br />(5) new Mini-warehouses on the northern twenty feet (20') of Lot 24 and Lots 25- <br />32. This action would require a zone change to General Commercial (GC). Mini- <br />warehouses (SIC #4225) are a "conditional" use in a GC zone. <br />
