City Attorney Knox Askins explained, "There is <br />strong language in the Quit Claim Deed negativing any warranty as to the condition of the <br />property environmental or other wise. That is an important issue, and we did not want any come <br />back on the City. It is our understanding Bay Port Industrial, which has the plant on McCabe <br />Road, is the purchaser of this property and probably will be coming to Council asking you to <br />expand his Industrial District so he can expand his operation." City Manager Robert T. Herrera <br />reported that before the City Council would entertain the idea to bring in the former Bay Mud <br />district the City had testing performed on that tract site where the treatment and/or transmittal <br />of sewage was provided. The testing came back negative. <br />City Attorney read: ORDINANCE 96-2124 - AN ORDINANCE MAKING FINDINGS OF <br />FACT; AUTHORIZING THE RE-CONVEYANCE BY REVERTER OF A 4.069 ACRE <br />TRACT OF LAND IN THE FORMER BAYSHORE MUNICIPAL UTILITY DISTRICT, TO <br />THE CARLA COMPANY, ET AL; FINDING COMPLIANCE WITH THE OPEN MEETINGS <br />LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Counciloerson McLauahlin to aAnrQVe.Ordinance 96-2124 as re <br />City Attorney,. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE <br />AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND JOHNNY <br />WEHBA BACKHOE SERVICE FOR CONSTRUCTION OF A (12") WATER LINE IN <br />THE WEST "K" STREET RIGHT-OF-WAY (Ord. 96-212a~ - G. Rankin <br />Director of Planning Guy Rankin reviewed the summary and recommendation for the request and <br />reported the total price of the contract for construction of the water line would be $20,002.50. <br />City Manager Robert T. Herrera and Assistant City Manager John Joerns answered questions <br />from Council. Mr. Herrera reported, "The City may have to take a lead role and put in some <br />additional infrastructure, whether it be water lines or sewer lines, in order to develop some <br />economic development for the City of La Porte. We will come back in the budget process with <br />something in that regard." <br />City Attorney read: ORDINANCE 96-2125 - AN ORDINANCE APPROVING AND <br />AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND JOHNNY <br />WEHBA BACKHOE SERVICE, FOR CONSTRUCTION OF A TWELVE INCH (12") WATER <br />LINE IN THE WEST "K" STREET RIGHT-OF-WAY; APPROPRIATING $20,002.50 TO <br />FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING <br />THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br />
