• <br />(4) in a structure: <br />(a) which has no sign visible from the exterior of the structure and no <br />other advertising that indicated a nude person is available for <br />viewing; and <br />(b) where in order to participate in a class a student must enroll at <br />least three days in advance of the class; and <br />(c) where no more than one nude model is on the premises at any one <br />time. <br />(D) It is a defense to prosecution under Section 5 that each item of <br />descriptive, printed, film, or video material offered for sale or rental, taken as a whole, <br />contains serious literary, artistic, political, or scientific value. <br />(E) Each day on which a violation occurs shall be a separate and distinct <br />violation. <br />SECTION. 11. AMENDMENTS <br />Section 5 may be amended only after compliance with the procedure required to <br />amend a zoning ordinance. Other sections of these Part IV regulations may be <br />amended by vote of the city council without compliance with the procedure required to <br />amend a zoning ordinance. <br />SECTION B. That H-I, Heavy Industrial District, of the Zoning Ordinance of the <br />City of La Porte is amended by adding a new subparagraph ( ) to read as follows: <br />( )Adult oriented business. <br />SECTION C. If any section, sentence, phrase, clause, or any part of any section, <br />sentence, phrase, or clause, of this ordinance shall, for any reason, be held invalid, <br />such invalidity shall not affect the remaining portions of this ordinance, and it is hereby <br />declared to be the intention of this City Council to have passed each section, sentence, <br />phrase or clause, or part thereof, irrespective of the fact that any other section, <br />sentence, phrase or clause, or part thereof, may be declared invalid. <br />SECTION D. The City Council officially finds, determines, recites and declares <br />that a sufficient written notice of the date, hour, place and subject of this meeting of the <br />City Council was posted at a place convenient to the public at the City Hall of the city <br />for the time required by law preceding this meeting, as required by the Open Meetings <br />Law, Chapter 551, Texas Government Code; and that this meeting has been open to <br />the public as required by law at all times during which this ordinance and the subject <br />matter thereof has been discussed, considered and formally acted upon.
