<br />e <br /> <br />e <br /> <br />Minutes Public Hearing <br />and Regular Meeting <br />La Porte City Council <br />September 23, 1996, Page 10 <br /> <br />Motion was made by Councilperson Sutherland to approve Ordinance 96-2136 as read by <br />the City Attornev. Second by Councilperson Maxwell. The motion carried, 9 ayes, 0 nays. <br /> <br />Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, <br />Clarke and Mayor Malone <br />Nays: None <br /> <br />Councilperson Gay asked that Council deviate from the agenda for a moment to recognize the <br />students who are in the audience tonight. Mayor Malone welcomed the students who were from <br />Deer Park High School. The students were instructed by their Government Teacher to attend <br />local area City Council meetings to obtain extra credits. The Mayor invited the students to come <br />forward after the Council meeting to ask questions of Council and City Staff. <br /> <br />13. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE <br />VACATING, ABANDONING AND CWSING TIlE ALLEY OF BWCK 133, TOWN OF <br />LA PORTE; RETAINING AN EASEMENT FOR EXISTING WATER, SANITARY <br />SEWER, HOUSTON UGHTING & POWER COMPANY, AND SOUTHWESTERN BELL <br />TELEPHONE COMPANY FACILmES (Ord. 96-2137) - G. Rankin <br /> <br />Director of Planning Guy Rankin reviewed the summary and recommendation for the request to <br />approve an ordinance to vacate, abandon, and close the alley of Block 133, Town of La Porte, <br />providing for a minimum 16' wide utility easement to be dedicated in place of the existing 16' <br />wide public alley and approve payment by applicant(s) of a $2,100.00 closing fee. The applicants <br />are La Porte Independent School District and the Church of Christ. Mr. Rankin and Mr. <br />Litchfield answered questions from Council. <br /> <br />City Attorney read: ORDINANCE 96-2137 - AN ORDINANCE VACATING, ABANDONING <br />AND CLOSING THE ALLEY OF BLOCK 133, IN THE TOWN OF LA PORTE, HARRIS <br />COUNTY, TEXAS; RETAINING AN EASEMENT FOR EXISTING WATER, SANITARY <br />SEWER, HOUSTON LIGHTING & POWER COMPANY, AND SOUTHWESTERN BELL <br />TELEPHONE COMPANY FACILITIES; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Council person Cooper to approve Ordinance 96-2137 as read by the <br />City Attorney. Second by Councilperson Maxwell. The motion carried, 9 ayes, 0 nays. <br /> <br />Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, <br />Clarke and Mayor Malone <br />Nays: None <br /> <br />14.
