CONSIDER APPROVING MINUTES OF REGULAR MEETING .JANUARY 27, 1997 <br /> <br />Motion was made by Council person Maxwell to ~prove the minutes of January 27th as <br />presented. Second by Councilperson Gay. The motion carried, 8 ayes, 0 nays. <br /> <br />Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell, Clarke and <br />Mayor Malone <br />Nays: None <br /> <br />4. PROCLAMATIONS: <br /> <br />AMERICAN mSTORY MONTH - SlURLEY SPum..ER <br /> <br />Mrs. Shirley Spuhler was unable to be at the City Council meeting and will receive the <br />proclamation at a later date. <br /> <br />AUDIO TAPE RECORDED THE PROCEEDINGS OF THE MEETING FROM ITEM 5 <br />THROUGHOUT THE REMAINDER OF THE CITY COUNCIL MEETING. <br /> <br />s. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX <br />PAYERS WISHING TO ADDRESS COUNCIL <br /> <br />Ms. Loyce Young, 823 W. Main, La Porte, addressed Council regarding the proposed revision <br />to Ordinance 1000, (Ord. 1000-1) the ordinance governing the manner of operation for <br />establishments wishing to serve wine and/or beer on premise in La Porte. Ms. Young spoke in <br />opposition to the revisions with respect to the 65% of gross income shall be derived from the <br />sales of prepared food. Ms. Young indicated she has been in business at 823 West Main, Brooks <br />Flag Stop since 1991, and she has had no trouble getting a City license renewed in the past. Ms. <br />Young indicated she bought the building in 1995 with an SBA loan through Bayshore Bank, and <br />had she known this was on the cities agenda she would not have done so. Also, Ms. Young <br />indicated she would be unable to keep the establishment open if she has to meet the 65 % sale of <br />food requirement. Ms. Young said, "I can sell some hot dogs, some hamburgers, but there is <br />no way I can compete with a restaurant. " <br /> <br />Mr. M. J. Bowden, 301 South Jamison, Morgan's Point, Texas, stated he has been a friend of <br />Ms. Young for several years. He indicated Ms. Young has had no probl"fDlS at her establishment. <br />Mr. Bowden reported to Council that Ms. Young gives away more food at her business than <br />some of the local restaurants sell. Ms. Young conducts her business inside the building, does <br />not have people standing around outside the building, nor does she have tailgate parties at the <br />establishment. He indicated he is a bar manager himself (The Point, 3919 E. Main) and in his <br />opinion her establishment is not big enough to have restaurant facilities. <br />
