~ f CASUAL CATERING CITY OF LA PORTE CONTRACT FOR PROVISION OF FOOD, BEVERAGE, AND CONCESSION SERVICES AT LITTLE CEDAR BAYOU WAVE POOL This Contract for provision of food, beverage, and concession Services (the "Contract") is entered into by and between CASUAL CATERING, whose address is 616 North Shady Lane, La Porte, Texas 77571 (hereinafter referred to as the "Concessionaire") and who agrees to provide food, beverage, and concession services as an independent contractor, and not an agent or employee, at the Little Cedar Bayou Wave Pool, located at 600 Little Cedar Bayou Drive, La Porte, Texas; (hereinafter referred to as "the Pool"); and the City of La Porte (hereinafter referred to as "the City") according to the terms set forth in this Contract. The Concessionaire agrees to perform the following services and to accept the following obligation during the term of the Contract: 1. GENERAL: The Concessionaire agrees to provide food, beverages, and concessions at the Pool according to the schedule set forth in Exhibit A and attached hereto. The services called for in this Contract shall be offered to the public at all times that a reasonable demand for such services exists, during such times which the Little Cedar Bayou Park Wave Pool is open to the public and subject to the requirements set forth in the proposal. Where approval or direction of the City is required for items, prices or procedures not specifically covered herein, such approval or direction will be granted by the City. Special promotional price or service changes will be allowed only following approval of the City. 2. CONCESSION EQUIPMENT FURNISHED: The Concessionaire will be responsible for maintaining the assigned premises and equipment in good repair and the replacement of any equipment damaged or missing through his operation. The cost of installing any new or added equipment, when approved by the city of La Porte, will be borne by the concessionaire and such equipment will be his property. At the termination of the contract, the Concessionaire may remove his own equipment, but will be responsible for leaving the premises in their original state of repair, less normal wear and tear, or replace or reimburse the city for any damaged or missing equipment assigned to him. This will be done to the satisfaction of the City of La Porte, prior to releasing the Concessionaire of his sureties from obligation. 3. ITEMS FOR SALE: The Concessionaire agrees to charge to the public the retail prices, exclusive of any sales tax, as shown on Exhibit A attached hereto, incorporated by reference herein, and made a part hereof for all purposes.
