AN ORDINANCE OF THE CITY OF LA PORTE, TEXAS, IMPOSING A <br />TEMPORARY MORATORIUM ON THE ISSUANCE OF PERMITS FOR <br />TOWERS FOR CELLULAR, PERSONAL COMMUNICATIONS <br />SERVICE (PCS), AND SPECIALIZED MOBIL RADIO SERVICE <br />TRANSMITTERS (SMR) (Ord. 98-2215) - G. Rankin <br />Planning Director Guy Rankin presented summary and recommendation to City <br />Council. Mr. Rankin informed City Council that the Planning and Zoning <br />Commission will conduct a Public Hearing on February 19, 1998, to receive <br />input on a proposed amendment to the Zoning Ordinance relating to cellular <br />towers. This Ordinance will establish a temporary moratorium on the issuance <br />of permits for towers for cellular, personal communications service (PCS), and <br />specialized mobile radio service transmitters (SMR). This moratorium, if <br />approved, would remain in effect Lind] May 19, 1998. <br />Mr. Rankin requested Council consider approving an ordinance establishing a <br />temporary moratorium on the issuance of permits for towers for cellular, <br />personal communications service (PCS), and specialized mobile radio service <br />transmitters (SMR). 1n addition, Mr. Rankin addressed questions from Council. <br />City Attorney read: ORDINANCE 98-2215 - AN ORDINANCE OF THE <br />CITY OF LA PORTE, TEXAS, IMPOSING A TEMPORARY <br />MORATORIUM ON THE ISSUANCE OF PERMITS FOR TOWERS FOR <br />CELLULAR, PERSONAL COMMUNICATIONS SERVICE (PCS), AND <br />SPECIALIZED MOBILE RADIO SERVICE TRANSMITTERS (SMR), <br />PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR THE <br />EXPIRATION OF THE MORATORIUM; PROVIDING A SAVINGS <br />CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; <br />AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Councilperson Engelken to approve this Ordinance as read <br />by the City Attorney. Second by Councilperson Ebow.
