• <br />City Council Meeting Minutes - February 9, 1998 <br />Page 5 <br />Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay, <br />Maxwell, Clark and Malone. <br />Nays: None <br />10. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN <br />ORDINANCE APPROVING AND AUTHORIZING A WATER SERVICE <br />AGREEMENT BETWEEN THE CITY OF LA PORTE AND SOUTHERN <br />IONICS INCORPORATED, FOR PROVISION OF POTABLE WATER <br />SERVICE - (Ord. 98-2218) D. Kneupper <br />Assistant City Manager John Joerns presented summary and recommendation to <br />City Council. Mr. Joerns informed Council that the term of the Water Service <br />Agreement is for five (5) years, plus any renewals and extensions thereof. <br />However, the Agreement shall automatically expire at such time as there is no <br />effective Industrial District Agreement between the parties or if the City <br />exercises the right of termination. <br />Assistant City Attorney read: ORDINANCE 98-2218 - AN ORDINANCE <br />APPROVING AND AUTHORIZING A WATER SERVICE AGREEMENT <br />BETWEEN THE CITY OF LA PORTE AND SOUTHERN IONICS <br />INCORPORATED, FOR PROVISION OF POTABLE WATER SERVICE; <br />MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE <br />SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; <br />AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Councilperson Sutherland to approve Ordinance 98-2218 <br />as read by Assistant City Attorney. Second by Councilperson Gay. The motion <br />carried, 9 ayes, 0 nays. <br />Ayes:: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay, <br />Maxwell, Clark and Malone. <br />Nays:: None <br />11. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN <br />ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE <br />CITY OF LA PORTE ON MAY 2, 1998; CALLING A RUN-OFF <br />ELECTION ON MAY 30, 1998, IF NECESSARY, AND CALLING FOR <br />ALL PROCEDURES NECESSARY FOR CONDUCTING SAID <br />ELECTION (Ord. 98-2219) - K.
