The La <br />Porte Soccer Club, along with Moorhouse Construction, Inc., has proposed a <br />solution that will allow a restroom/concession building to be constructed that <br />remains within budget for the project. The City would relinquish $35,000 in <br />funds plus accumulated interest back to the association, which they provided for <br />the initial project. The association and Moorhouse Construction, Inc. would <br />enter into a separate agreement to provide an improved restroom/concession <br />building at Northwest Park that would better meet the needs of the association. <br />The construction process would meet the City's requirements for bonding and <br />insurance as well as standard inspections to assure code compliance. Upon <br />complc~tion and acceptance, the City would provide up to $15,000 to the <br />association to assist in the funding process. The completed structure would <br />become the sole property of the City and its use governed by a separate <br />agreement with the association. The City's share of described funding has <br />already been embarked for the project through the prior agreement. <br /> <br />Staff rc~commends that the ordinance authorizing a new proposed agreement <br />betwee:n the City of La Porte and the La Porte Soccer Club for this project, be <br />approved. <br /> <br />City Attorney Knox Askins read: ORDINANCE 98-2229 - AN ORDINANCE <br />APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE <br />CITY OF LA PORTE AND THE LA PORTE SOCCER CLUB, REGARDING <br />THE CONSTRUCTION OF A BUILDING AT NORTHWEST PARK; <br />SUPERSEDING A LIKE AGREEMENT BETWEEN THE PARTIES DATED <br />AUGUST 12,1996; MAKING VARIOUS FINDINGS AND PROVISIONS <br />RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE <br />HEREOF. <br /> <br />Motion was made by Councilperson Ebow to approve this Ordinance as read by <br />the City Attorney. Second by Councilperson Porter. The motion carried, 9 <br />ayes, 0 nays. <br /> <br />Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay, <br />Maxwell, Clark and Mayor Malone. <br />Nays: .
