. Ord. 98-2260 . e COpy like or similar circumstances. Section 5. ADDITIONS TO SERVICE AREA BY ANNEXATION OR OTHERWISE. 1. Subject to the provisions of Section 5(2) below, the Service Area shall include: (1) territory which is added by the City during the tenn of this Franchise and which is contiguous to the Service Area and; (2) non-contiguous territory which is served by the Grantee and which is subsequently added by the City during the tenn of this Franchise. 2. Whenever the Grantee shall receive a request for Cable Service from at least 15 residences within 1320 cable-bearing stand feet (one-quarter cable mile) ofits trunk: or distribution cable, it shall extend its Cable System to such Subscribers at no cost to said Subscribers other than the standard/non-standard charges for installation; provided that such extension is technically feasible, and if it will not adversely affect the operation, financial condition, or market development of the Cable System. Section 6. PAYMENT TO THE CITY. 1. Amount and Time. As compensation for the right, privilege and franchise herein conferred, the Grantee shall pay to the City each year during the term of this Franchise a sum equal to three percent (3%) of the Grantee's Gross Revenues for such year, or portion thereof. Such franchise fee payments shall be made quarterly on or before each May 30, August 30, November 30, and February 28, for the most recently ended quarter. At the time such payments are made, the Grantee shall file with the Director a financial report showing in detail the components of Gross Revenues of the Grantee during the preceding quarter or portion thereof. The City reserves the right to increase the franchise fee up to 5% of Grantee's Gross Revenues per year, upon providing Grantee 120 days prior written notice. 7
