<br />e <br /> <br />e <br /> <br />Note: <br />Council Agenda Items 5 & 6 Public Hearing and Creation of TIRZ will need to be handled a <br />little differently than discussed at the Council Workshop Meeting. <br /> <br />· After review of our documents and the proposed state law changes, we are recommending a change <br />in the process of creating the TIRZ (with the expanded boundaries). ' <br />Mr. Hawes, on advice of an attorney familiar with TIRZ's and the proposed state law, suggests the <br />following to keep our public record very clean and open. In summary: <br /> <br />1. At the May 17th workshop, we discussed expanding the boundaries of the Zone at the Monday, <br />May 24th Council Meeting. Unfortunately, we will need to break this into two steps. <br /> <br />2. We will be able to add the LPISD property on Monday, May 24, 1999 because they will appear <br />and asked to be included. We can add the street connectors because they are not private <br />property. However, it is not suggested we add the other areas discussed until a 2nd Public <br />Hearing is held. <br /> <br />3. At the May 24, 1999 Public Hearing, Council can direct staff to prepare for an addition or <br />amendment to the TIRZ which was originally described in the Public Hearing Notice. <br /> <br />4. This will require a 2nd Public Hearing to occur at a later date. This 2nd hearing and notice will <br />include the other properties Council considered adding. This then satisfies notice of those <br />property owners in a more explicit manner. <br /> <br />5. The taxing entities will be notified again, prior to May 31 st, of the proposed additions which <br />will meet the test of the proposed legislation. <br /> <br />6. Because of this change in approach, we have a few blanks in the creation ordinance and the <br />exhibits that have to be re-done. This information will be completed and available at the <br />meeting. <br />
