• • <br />RESOLUTION NO. 2000- pQ_ <br />A RESOLUTION OF INTENT TO REMAIN A CLASS MEMBER IN THE CLASS ACTION <br />CITY OF WHARTON, ET AL. V. HOUSTON LIGHTING & POWER COMPANY; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br />WHEREAS, the City of La Porte has previously chosen to remain <br />a member of the Plaintiff class in the lawsuit styled City of <br />Wharton, et al, v. Houston Lighting & Power Company, et al, Cause <br />No. 96-016613, pending in the 269th Judicial District Court of <br />Harris County, Texas; <br />WHEREAS, the City Council wishes to affirm its intent to be <br />and remain a member of the Plaintiff class in that case; and <br />WHEREAS, the City Council wishes to affirm its intent to be <br />and continue to be represented by the Court designated class <br />counsel, Benjamin L. Hall, III and John M. O'Quinn with the law <br />firm of O'Quinn & Laminack; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA FORTE: <br />Section 1. That the City Council of the City of La Porte <br />reaffirms and expresses the intent and desire of the City to be and <br />remain a member of the Plaintiff class and continue to be <br />represented by Benjamin L. Hall, III and John M. O'Quinn with the <br />law firm of O'Quinn & Laminack, in the action styled Cities of <br />Wharton, Pasadena and Galveston, Individually and as Rule 42 Class <br />Representatives v. Houston Lighting & Power Company and Houston <br />Industries Finance Co., Inc., Cause No. 96-011613, In the 269th <br />Judicial District Court of Harris County, Texas. <br />Section 2. The City Council officially finds, determines, <br />recites, and declares that a sufficient written notice of the date, <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />City for the time required by law preceding this meeting, as <br />required by the Open Meetings Law, Chapter 551, Texas Government <br />
