(g) Health and Safety Standards. An owner shall: <br />(1) Take effective action to substantially eliminate insects, rodents, <br />ectoparasites or other pests in or on the premises; <br />(2) Provide any dwelling, dwelling unit or guest room with a screen for <br />keeping out insects at each opening of the building if the building is <br />not cooled with refrigerated air; <br />(3) Maintain the interior of a vacant building or vacant. portion of a . <br />building free from rubbish and garbage; <br />(4) Properly grade the property surrounding a building to obtain <br />thorough drainage and to prevent the accumulation of stagnant wa- <br />ter on the owner's property or on surrounding properties; <br />(5) Comply with all applicable building and property requirements of <br />Chapter 34, Environment, Chapter 38, Fire Prevention and <br />Protection; Chapter 82, Buildings and Building Regulations; and <br />Chapter 106, Zoning, of the Article of Ordinances of the City of La <br />Porte. <br />(h) It is an affirmative defense to a prosecution of an owner for violation of <br />this Section that: <br />(1) The premises concerned is the site of new construction and <br />reasonable and continuous., progress is. being made to complete the <br />construction, or <br />(2) With respect to subsections involving a landlord/tenant relationship <br />that: <br />• The applicable utilities were disconnected from the premises if <br />the owner was legally authorized to cause the termination of <br />utility service to an applicable rental unit because of <br />non-payment of rent, and <br />• The tenant did not pay the utilities directly to the utility company, <br />and <br />• The premises otherwise were in substantial compliance with this <br />Article, or <br />(3) The substandard condition was not capable of discovery by the <br />owner upon reasonable investigation or inspection. <br />Page 7 <br />
