The request, submitted by Mr. <br />Edward Dutko, seeks approval of a General Plan and a Special Conditional Use Pennit (SCUP). The General Plan <br />is for the entire 107 acre tract and the SCUP is for Phase One consisting of 16.2 acres of multi-family residential <br />development to be known as Park Forest Apartments. The property is located at the southeast comer of SH 146 and <br />McCabe Road. <br /> <br />This General Plan demonstrates that 75.7 acres out of 107 acres would need to be preserved in perpetuity as a <br />Conservation Easement based on a pennit the applicant received from the US Army Corps of Engineers. The <br />remaining developable acreage shows 28.5 acres as high-density residential and 1.35 acres as a commercial comer. <br /> <br />A detailed analysis of this project is provided as a staff report that was previously presented to the Planning <br />and Zoning Commission. Six (6) notices of public hearing were mailed to surrounding property owners. One <br />response was received in this regard. <br /> <br />The Planning and Zoning Commission, by unanimous vote, has recommended approval of Special Conditionai Use <br />Pennit #SCUoo.oo 1 with the following conditions: <br />1. The overall density of the project (Phase 1 & 2) shall not exceed 19.7 dwelling units per acre. <br />2. The applicant shall enter into Sewer Service Agreement and commit to paying for lift station <br />upgrades related to this development project. <br />3. This action in no way commits the City to any maintenance responsibilities for the 7S.7 acre <br />Conservation Easement. <br /> <br />Action Reauired bv Council: <br /> <br />1.
