The <br />project is located at the northwest corner of Underwood Road and Fainnont Parkway just southof Caniff Road. At City Council's <br />October 22, 2001 meeting, the proposed development was rezoned from the Neighborhood Conunercial (NC) to the Planned Unit <br />Development (PUD) zoning dis1rlct. Development within a PUD zone requires the approval of a General Plan along with a Special <br />Conditional Use Pennit (SCUP). <br /> <br />In November 2001, the applicant submitted a General Plan for a four-phased project to build an office park with a small <br />retail/shopping area. The applicant also submitted an application for a Special Conditional Use Permit (SCUP) for Phase I of the <br />development This phase consists of 2.8 acres with a parking lot, a two-story office building (32,006 sq. ft.), and detention pond <br />ft.... - 1!>,000 sq. ft). The applicant also developed a list of proposed uses for Phase I. <br />Alor6 <br />o During review of this proposal, staff considered compatibility of uses and conditions. To ensure compatibility with surrounding uses, <br />Phase I is limited to general office building uses and other office activities - no warehousing, storage, installation, gambling, etc. <br />Document I lists these permitted uses. <br /> <br />At the November 29, 2001 Planning and Zoning Commission meeting, the Commission approved the General Plan. During the same <br />meeting, the Planning and Zoning Commission held a public hearing to receive testimony regarding the Special Conditional Use <br />Permit (SCUP) request Twenty-one notices of public hearing were mailed to neighboring property owners; however, no responses <br />were received. The Commission, by unanimous vote, forwarded a recommendation to Council to approve Special Conditional Use <br />Permit (SCUP) #SCUO 1-004 with the following conditions: <br /> <br />1. The permitted uses in Phase lare limited to those shown on Docwuent 1. <br />2. The developer shall use the covenants and res1rlctions similar to those listed in Document 2. <br /> <br />If approved, the next step for the applicant would be to submit, for the Commission's consideration, a Major Development Site Plan. <br /> <br />Action Required by Council: <br />1.
