<br />e <br /> <br />e <br /> <br />City Council Minutes 8-12-02 - Page 6 <br /> <br />Assistant City Attorney John Armstrong read: ORDINANCE 2002-2572 - AN <br />ORDINANCE REPEALING CHAPTER 34, ENVIRONMENT, ARTICLE 3, NOISE, <br />SECTIONS 34-91 THROUGH 34-94, INCLUSIVE, AND REPLACING SAID <br />REPEALED SECTIONS WITH A NEW CHAPTER 34, ENVIRONMENT, ARTICLE 3, <br />NOISE POLLUTION, SECTIONS 34-91 THROUGH 34-97 OF THE CODE OF <br />ORDINANCES OF THE CITY OF LA PORTE; PROVIDING THAT ANY PERSON <br />VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF <br />A MISDEMANOR AND SHALL UPON CONVICTION BE FINED A SUM OF NOT <br />MORE THAN TWO THOUSAND DOLLARS ($2,000.00) FOR EACH VIOLATION; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Griffiths to approve this ordinance as presented by <br />Mr. Kneupper. Second by Councilmember Ebow. Council considered disapproval or other action regarding Special Conditional Use Permit <br />#SCU02-00 1. <br /> <br />Director of Planning Doug Kneupper presented summary and recommendation and <br />answered Council's questions. <br /> <br />Assistant City Attorney John Armstrong read: ORDINANCE 1501-VV - AN ORDINANCE <br />AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER <br />106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE <br />CITY OF LA PORTE, BY GRANTING A SPECIAL CONDITIONAL USE PERMIT FOR <br />THAT CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS, TO-WIT: 2.9 <br />ACRES, BEING LOTS 1 THRU 32 OF BLOCK 329, INCLUDING ALLEY AND <br />PORTION OF NORTH 2ND STREET RIGHT -OF-WAY, OUT OF JOHNSON HUNTER <br />SURVEY, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, FOR THE PURPOSE OF <br />DEVELOPING AND OPERATING A CONVENIENCE STORE WITH AUTOMOBILE <br />AND TRUCK FUELING WITHIN A BUSINESS INDUSTRIAL (BI) ZONE; MAKING <br />CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Warren to approve this ordinance as presented by Mr. <br />Kneupper. Tuftli Trust. <br />
