"OFF- <br />STREET PARKING", OF THE CODE OF ORDINANCES OF THE CITY OF LA <br />PORTE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS <br />ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND SHALL <br />UPON CONVICTION BE FINED A SUM OF NOT MORE THAN TWO THOUSAND <br />DOLLARS ($2,000.00) FOR EACH VIOLATION; FINDING COMPLIANCE WITH <br />THE OPEN MEETINGS LAW; PROVIDING A SAVINGS CLAUSE AND A <br />SEVERAB.[LITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Second by Councilmember Engelken to Councilmember Griffiths' motion. <br />Chairperson Betty Waters of the Planning and Zoning Commission, informed Council to <br />clearly understand the Commission did not arrive at the recommendations before you in a <br />matter of minutes or hours, it was days and days of considering every aspect of the <br />recommendations that aze being covered tonight. <br />Upon the conclusion of Mrs.Waters' questions and answers, Councilmember Griffiths <br />repeated his recommendation that we accept the ordinance as stated, striking out any <br />reference to sepazation provisions. Mayor questioned if Councilmember Engelken still <br />wanted to second the motion, Mr. Engelken withdrew his earlier second, thinking we <br />should include the 1000-foot separation as stated earlier. Councilmember Meismer asked <br />if Mr. Griffiths would be willing to amend his motion to 1000-foot separation. <br />Councilmember Mosteit seconded Mr. Griffiths' motion of striking out any reference to <br />separation provisions. The motion failed. <br />Ayes: Griffiths, Mosteit <br />Nays: Warren, Meismer, Engelken, Beasley, Ebow, Young and Malone <br />Abstain: None <br />Motion was made by Councilmember Engelken to consider the adoption of the ordinance <br />uadate re ag rding mid and hi hg, densi development, having 1000-foot sepazation. Second <br />by Councilmember Beasley. The motion carried. <br />Ayes: Mosteit, Warren, Meismer, Engelken, Beasley, Ebow, and Malone <br />Nays: Griffiths, Young <br />Abstain: None <br />9. Council to consider adopting a resolution extending the moratorium on mid to high <br />density residential development for an additional 90 days. <br />
