<br />City Council Meeting - tle 23, 2003 - Page 3 <br /> <br />e <br /> <br />Councilmember Warren questioned if the Committee will get input from citizens. <br />Councilmember Mosteit informed Council they will research the background on La Porte <br />drainage, history of the ordinances, testimonies from the c~tizens, determine what needs are <br />to strengthen the Ordinance to the benefit of the majority, ifnot all the citizens. Mr. Mosteit <br />wants to be assured that when permits are issued; they are in full compliance with the <br />Ordinance and that other citizens are not harmed. <br /> <br />Councilmember Beasley obtained clarification on how many loads of dirt citizens are <br />allowed to have without a permit (up to Sloads). <br /> <br />Assistant City Attorney John Armstrong indicated that existing permits have property rights <br />attached to them, however, those rights only go to the four comers of the permit themselves, <br />so if improper activity is being conducted outside the scope of the permit, such improper <br />activity is subject to enforcement <br /> <br />Motion was made bv Councilmember Beasley to approve Resolution 2003"-19 as presented <br />by Mr. Cummings. Second by Councilmember Mosteit. The motion carried. <br /> <br />Ayes: Engelken, Meismer, Mosteit, Warren, Young, Beasley, Ebow, Griffiths and Malone <br />Nays: None <br />Abstain: None <br /> <br />8. Council to consider approval of ordinance to vacate, abandon, and close the West Polk <br />Street Right-of-Way between Blocks 696 and 709, Town of La Porte. <br /> <br />Supervising Engineer Robert Cummings read summary and recommendation and answered <br />Council's questions. <br /> <br />Assistant City Attorney read: ORDINANCE #2003-2636 - AN ORDINANCE VACATING, <br />ABANDONING AND CLOSING THE WEST POLK STREET RIGHT -OF-WAY, <br />BETWEEN BLOCKS 696 AND 709, TOWN OF LA PORTE, HARRIS COUNTY, <br />TEXAS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTNE DATE HEREOF. <br /> <br />Motion was made bv Councilmember EnlZelken to approve Ordinance 2003-2636 as <br />presented bv Mr. CumminlZs. Second by Councilmember Ebow. The motion carried. <br /> <br />Ayes: Engelken, Meismer, Mosteit, Warren, Beasley, Ebow, Griffiths and Malone <br />Nays: Young <br />Abstain: None <br /> <br />9. Council to consider approval or other action regarding an ordinance appointing alternate <br />judges of the City of-La Porte Municipal Court. <br /> <br />Municipal Judge Louie Ditta read the summary and recommendation and answered <br />Council's questions. <br /> <br />Assistant City Attorney read: ORDINANCE 2003-2640 - AN ORDINANCE <br />APPOINTING ALTERNATE JUDGES OF THE CITY OF LA,PORTE MUNICIPAL <br />COURT, PROVIDING A SEVERABll..ITY CLAUSE, CONTAINING A REPEALING <br />CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, <br />
