<br />City Council Regular Meeting, Public Hearing and Workshop Meeting - March 22, 2004 - Page 3 <br /> <br />Interim Planning Director Nick Finan presented summary and recommendation and answered Council's <br />questions. <br /> <br />Assistant City Attorney John Armstrong read: ORDINANCE 1501-JJJ - AN ORDINANCE AMENDING <br />THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY <br />REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING THE <br />ZONING CLASSIFICATION FROM PLANNED UNIT DEVELOPMENT TO GENERAL COMMERCIAL <br />REQUESTED BY MR. JAMES ELMORE ON BEHALF OF THE OWNER OF THIS THREE ACRE <br />TRACT LOCATED AT THE SOUTHEAST CORNER OF WHARTON WEEMS BOULEVARD AND <br />STATE HIGHWAY 146 HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT RELATED <br />TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING <br />AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Beasley to not approve Ordinance 1501-JJJ as recommended by the <br />Planning and Zoning Commission. Council to consider adopting/approving a resolution opposing any School Finance or Tax System Reforms that <br />would negatively affect City Revenues and Economic Development. <br /> <br />Assistant Finance Director Michael Dolby presented summary and recommendation and answered Council's <br />questions. <br /> <br />Assistant City Attorney John Armstrong read: RESOLUTION 2004-08 - A RESOLUTION OF THE CITY <br />OF LA PORTE, TEXAS, OPPOSING ANY SCHOOL FINANCE OR TAX SYSTEM REFORMS THAT <br />WOULD NEGATIVELY AFFECT CITY REVENUES AND ECONOMIC DEVELOPMENT EFFORTS. <br /> <br />Motion was made by Councilmember Meismer to approve Resolution 2004-08 as presented by Mr. <br />Dolby. Second by Councilmember Engelken. The motion carried. <br /> <br />Ayes: Mosteit, Ebow, Beasley, Griffiths, Engelken, Young and Meismer <br />Nays: None <br />Abstain: None <br /> <br />10. Council to consider approval or other action of an ordinance authorizing the City Manager to execute a Letter <br />Agreement with Center Point Energy in the amount of $56,500.00 for the relocation of overhead electrical <br />facilities on Canada Road. <br /> <br />Public Works Director Steve Gillett presented summary and recommendation and answered Council's <br />questions. <br /> <br />Assistant City Attorney John Armstrong read: ORDINANCE 2004-2710 - AN ORDINANCE APPROVING <br />AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND CENTERPOINT <br />ENERGY, TO PROVIDE RELOCATION OF OVERHEAD ELECTRICAL FACILITIES FOR THE <br />CANADA ROAD PROJECT; APPROPRIATING THE SUM NOT TO EXCEED $56,500.00, TO FUND <br />SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE <br />SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Meismer to approve Ordinance 2004-2710 as presented by Mr. <br />Gillett. Second by Councilmember Mosteit. The motion carried. <br />
