City Council Regular Meeting, Wo~-op Meeting and Public Hearing - Apri12.04 -Page 6 <br />Interim Planning Director Nick Finan presented summary and recommendation and answered Council's <br />questions. <br />Assistant City Attorney C1ark~Askins read: ORDINANCE 1501-LLL• & R04-002- AN ORDINANCE OF THE <br />CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING <br />ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING THE ZONING CLASSIFICATION FROM <br />MEDIUM DENSITY RESIDENTIAL TO HIGH DENSITY RESIDENTIAL REQUESTED BY <br />TRANSPORT REALTY, INC. THE OWNER OF THIS EIGHTEEN ACRE TRACT LOCATED IN THE <br />3000 BLOCK OF CANADA ROAD HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT <br />RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF; <br />Motion was made by Councilmember Engelken to approve the recommendation of the Planning and Zoning <br />Commission and deny approval of the request and not pass the Ordinance. Second by Councilmember <br />Meismer. The motion carried and Ordinance 1501-LLL and R04-002 was not passed. <br />Ayes: Mosteit, Ebow, Beasley, Griffiths, Engelken, Young and Meismer <br />Nays: None <br />Abstain: None <br />13. Council to consider approving an ordinance authorizing the City Manager to execute a contract with Brooks <br />Concrete, Inc. in the amount of $59,659.21 which included a 5% contingency. <br />Interim Planning Director Nick Finan presented summary and recommendation and answered Council's <br />questions. <br />Assistant City Attorney Clark Askins read: ORDINANCE 2004-2728 - AN ORDINANCE APPROVING <br />AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND BROOKS <br />CONCRETE, INC. FOR CONSTRUCTION OF THE 2004 CITY-WIDE SIDEWALK IMPROVEMENT <br />PROJECT; APPROPRIATING $59,659.21 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS <br />AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Councilmember Engelken to approve Ordinance 2004-2728 as presented by Mr. Finan. <br />Second by Councilmember Meismer. The motion carried. <br />Ayes: Mosteit, Ebow, Beasley, Griffiths, Engelken, Young and Meismer <br />Nays: None <br />Abstain: None <br />14. Council to consider authorizing staff and the city attorney to proceed with drafting an agreement for the lease <br />of a portion of unimproved Lomax School Road ROW North of "P" Street. <br />Interim Planning Director Nick Finan presented summary and recommendation and answered Council's <br />questions. <br />Motion was made by Councilmember Beasley to approve the agreement for staff to move forward in assisting <br />the residents with an agreement and have the City Attorney review prior to Council approval. Second by <br />Councilmember Ebow. The motion carried. <br />Ayes: Mosteit, Ebow, Beasley, Griffiths, Engelken, Young and Meismer <br />Nays: None <br />Abstain: None <br />
