G Street intersecting S. 8t Street, was heard before the Zoning Board of Adjustment. <br />The variance specifically requested relief from the 45' maximum height requirement within a <br />General Commercial and/or Industrial Zone. Only 4 Board members were in attendance. While <br />the motion was made to approve the request, the vote was 3 for and 1 against the proposal. Any <br />vote to approve a variance or. special exception requires 4 votes from the Board. Staff has <br />received a request, in writing, by the Chairperson of the Board to bring the issue back before the <br />Board at the next meeting on September 23, 2004, for full consideration. <br />City Council has expressed an interest in considering a change to the Zoning Regulations, <br />Chapter 106 of the City Code :of Ordinances that would modify the 45' maximum height rule. <br />Section 106-171. Amendment procedures, states in part that the City Council may, on its own <br />motion, amend, supplement, change or modify the regulation. Section 106-171 (1) goes on to <br />state that before taking any action on any proposed amendment, supplement, change or <br />modification, the city council shall submit the same issue to the city planning and zoning <br />commission which shall make a preliminary report and hold a public hearing thereon before <br />submitting its final report to the city council. <br />Action Required by Council: <br />Consider a motion for the Planning and Zoning Commission to consider proposed amendments <br />to Chapter 106, Sections 106-443 and 106-522; to amend, change or modify maximum height <br />limits permitted in commercial and industrial zones. <br />Approved for City Council Aaenda <br />4B <br />Date <br />
