This would be in exchange for the abatement of the trees obstructing the stopping sight triangle <br />at the northeast comer of South 4th Street and West Fainnont Parkway and for the cessation of parking of private <br />vehicles in the public right-of-way at the same location <br /> <br />The question was raised at the 3/28/05 Council meeting whetbeJ" or not public bids would be needed to lease out city <br />owned land. Staffhas checked with the legal counsel and ascertained that public bids will not be required. Council <br />has the following options: <br /> <br />1. If Council is interested in the potential use as described in the 3/28/05 Council meeting, Staff now asks that <br />Council direct staff to approach the Planning & Zoning Commission for a Special Conditional Use Permit <br />(SCUP) for off-site parking. <br />2. Direct staff to seek additional solutions to the above described sight triangle and parking problem. <br />3. Table the issue for further consideration. <br />4. Direct staff to instruct the landowner to cease and desist private parking on public right-of-way and remove <br />the obstructing trees at his expense. <br /> <br />The site is within 300 feet of the primary facility as required by the Zoning Ordinance. A public hearing is not <br />required. <br /> <br />Action Reauired bv Council: <br /> <br />Direct staff to approach the Planning & Zoning Commission for a SCUP for off-site parking if Council is interested <br />in leasing city owned land to Dr. Patel for such a use. <br /> <br />~ <br />~ &-Md. <br /> <br /> <br />4-0~05 <br /> <br />Date <br />
