<br />City Council Regular Meeting - June 26, 2006 <br /> <br />Page 4 <br /> <br />Chief Richard Reff presented summary and recommendation and answered Council's <br />questions. <br /> <br />Assistant City Attorney Clark Askins read: ORDINANCE 290 I-AN ORDINANCE <br />AMENDING CHAPTER 42 "MISCELLANEOUS OFFENSES" OF THE CODE OF <br />ORDINANCES OF THE CITY OF LA PORTE BY ADDING ARTICLE V <br />"REGULATION OF SEX OFFENDER RESIDENCY" MAKING IT UNLAWFUL FOR <br />CERTAIN SEX OFFENDERS TO RESIDE WITHIN 1000 FEET OF PREMISES WHERE <br />CHILDREN GATHER; PROVIDING FINDINGS OF FACT AND OTHER MATTERS <br />RELATED THERETO; PROVIDING AFFIRMATIVE DEFENSE; PROVIDING FOR A <br />PENALTY; PROVIDING A SEVERABILITY CLAUSE; CONTAINING AN OPEN <br />MEETINGS CLAUSE; PROVIDING FOR THE PUBLICATION OF THE CAPTION <br />HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Barry Beasley advised staff to keep City Council updated on lawsuits. <br /> <br />Motion was made by Council member Griffiths to approve the Ordinance 2901 adopting <br />1000 ft. as presented by Mr. Reff. Second by Council member Clausen. The motion carried <br /> <br />Ayes: Mosteit, Moser, Beasley, Engelken, Griffiths, Rigby, Clausen, Ebow and Mayor <br />Porter. <br />Nays: None <br />Abstain: None <br /> <br />12. Council to consider approval or other action regarding an ordinance appointing members to <br />the Chapter 172 Board. <br /> <br />Mayor Porter presented summary ~nd recommendation and answered Council's questions. <br /> <br />Assistant City Attorney Clark Askins read: ORDINANCE 2004-2782-K-AN <br />ORDINANCE APPOINTING MEMBERS TO VARIOUS BOARDS, COMMISSIONS, <br />AND COMMITTEES, OF THE CITY OF LA PORTE; PROVIDING A SEVERABILITY <br />CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH <br />THE OPEN MEETINS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Council member Beasley to approve the Ordinance 2004-2782-K <br />appointing Tina Fregia to the Chapter 172 Board and creating and appointing George Van <br />Dyke to Alternate Citizen Position 1. Second by Council member Griffiths. The motion <br />carried <br /> <br />Ayes: Mosteit, Moser, Beasley, Engelken, Griffiths, Rigby, Clausen, Ebow and Mayor <br />Porter. <br />Nays: None <br />Abstain: None <br /> <br />13. It was the consensus of Council to direct IT to work on a request for proposal for Fiber <br />Optics. <br /> <br />IT Manager Al Owens presented summary and recommendation and answered Council's <br />questions. <br />
