Motion was made by Council member Ebow to approve Ordinance 1501-K5 as recommended by Planning and Zoning Commission. Second by Council member Clausen. The motion carried. Ayes: Mosteit, Engelken, Rigby, Ebow, Clausen, and Mayor. Nays: Moser Abstain: None 9. Public Hearing - Council to consider approval or other action on recommendation by Planning & Zoning Commission approve Rezone Request # R06-003, for TRS 692C, 693B, 706, and 707, La Porte Outlots, rezoned from Medium Density Residential (R-2) to General Commercial (GC). Open Public Hearing - Mayor Porter opened the Public Hearing at 6:43 p.rn. Director of Planning Wayne Sabo presented summary and recommendation and answered Council's questions. Public Input: Claudia Rogers - 9221 Barton Ct. La Porte, Texas - spoke in opposition to the rezone request but was pleased the city would build a park on Canada Road. Ms. Rogers thanked Mr. Engelken for informing the community of the advantages but still opposes the rezone. Bobby Grisham - 4650 Center St. Deer Park, Texas - spoke in favor of the Rezone Request and supports the Buxton Study/commercial development on Canada Road. Paul Dawson - 1106 Angela Deer Park, Texas - spoke in favor of the Rezone Request and supports the commercial development. Gilbert Duran - 9225 Barton Ct. La Porte, Texas- spoke in opposition to the rezone request and was concerned with the traffic the development would create in the area. Mr. Duran also informed Council there would have been more signatures on the petition if more time was allowed. Sandi Paulus - 9225 San Saba Ct. La Porte, Texas - spoke in opposition to the rezone request due to noise pollution it would create once the trees are removed for the development. Ms. Paulus asked Council to place the park near the homes. Douglas Paul- 9218 Barton Ct. La Porte, Texas - spoke in opposition due to the traffic/noise the development would create. Estevan Campos - 9204 Tejas - La Porte, Texas - addressed council about possibly changing the design and placing the park closer to the neighborhood. Elizabeth Auterson - 3729 Choctaw Dr. La Porte, Texas - spoke in opposition to the rezone request. Ms. Auterson was concerned she did not receive a notice of the proposed development.
