ASSURANCES <br /> <br />The CITIES assures that no person shall, on the grounds of race, creed, color, handicap, <br />national origin, gender, political affiliation or beliefs, be excluded from, be denied benefit of, <br />or be subject to discrimination under any program or activity funded in whole or in part <br />under this agreement. Incorporated by reference the same as if specifically written herein <br />are rules, regulations, and all other requirements imposed by law, including but not limited <br />to compliance with those pertinent rules and regulations of the State of Texas and those of <br />United States agencies providing funds to the State of Texas. <br /> <br />To the extent it applies, CITIES/CITIES shall comply with Texas Government Code, <br />Chapter 783, 1 TAC 5.141 et seq., and the Uniform Grant Management Standards, State <br />Uniform Administrative Requirements for Grants and Cooperative Agreements, Section III, <br />Subpart B, 9_.14 (Attached as "Attachment 3"). <br /> <br />12. AUDIT REQUIREMENTS <br /> <br />The CITIES hereby agrees to comply with the requirements specified in the Single Audit <br />Act, 31 U.S.C. 997500 et seq. (Supp.1999) (Public Law 104-156), as applicable. <br /> <br />13. WRITTEN MODIFICATION <br /> <br />No modification or amendment to this Agreement shall become valid unless in writing <br />and signed by both parties. <br /> <br />14. EQUAL EMPLOYMENT OPPORTUNITY <br /> <br />The Grantee agrees to comply with all provisions of Executive Order No. 11246 <br />(September 24, 1965), and of the rules, regulations, and relevant Orders of the <br />Secretary of Labor. <br /> <br />15. RIGHTS IN DATA <br /> <br />A. The term "subject data" as used in this agreement means recorded information, whether <br />or not copyrighted, that is delivered or specified to be delivered under this Agreement. <br />The term includes graphic or pictorial delineations in media such as drawings or <br />photographs; audio-visual recordings such as films or videotapes; text in specifications <br />or related performance or design-type documents; machine forms such as punched <br />cards, magnetic tape, or computer memory printouts; and information retained in <br />computer memory. <br /> <br />1) Examples of "subject data" include, but are not limited to: engineering drawings <br />and associated' lists; specifications; standards; process sheets; manuals; technical <br />reports; catalog item identifications; and related information. <br /> <br />2) The term does not include financial reports, costs analysis, and similar <br />information incidental to program administration. <br />
