<br />Page 1 of 10 <br /> <br />Contract Number 07-DEM-LEPC- 8 <br /> <br />AGREEMENT FOR HAZARDOUS <br />MATERIALS EMERGENCY <br />PREPAREDNESS PLANNING GRANT <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF TRAVIS <br /> <br />PARTIES <br /> <br />Pursuant to the authority of TEXAS GOVERNMENT CODE 99 418.043 and 418.044 and/or 9 <br />791.011, this agreement for a Hazardous Materials Emergency Preparedness Planning grant is <br />made by and between the State of Texas, acting by and through the Texas Department of <br />Public Safety, Governor's Division of Emergency Management, hereinafter called the "STATE," <br />and La Porte. Moraan's Point. Shoreacres hereinafter referred to as the "CITIES," serving as a <br />fiscal agent for the Cities of La Porte. Morqan's Point. Shoreacres Local Emergency Planning <br />Committee (LEPC). <br /> <br />WITNESSETH <br /> <br />WHEREAS, the STATE has no programmed resources to implement this requirement of federal <br />law; and <br /> <br />WHEREAS, the STATE will receive funds from the United States Department of Transportation <br />(DOT) to accomplish the tasks detailed in this agreement. <br /> <br />AGREEMENT <br /> <br />NOW, THEREFORE, the STATE and the CITIES in consideration of the mutual covenants and, <br />agreements contained herein, do mutually agree as follows: <br /> <br />The CITIES agrees to perform hazardous materials emergency preparedness planning activities in <br />connection with the project as stated in the Articles to follow and outlined hereafter, and for having <br />rendered such services, the STATE agrees to pay to the CITIES compensation for these services as <br />set out in this agreement. All services performed under this agreement shall be performed under the <br />supervision of the State Coordinator, Governor's Division' of Emergency Management (GDEM), <br />represented by the Hazardous Materials Training Officer as the STATE project officer. <br />
